• Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.

• You may print or download one copy of a reasonable number of pages of the Website for your own personal, non-commercial use and not for further reproduction, publication, or distribution.

• If We provide desktop, mobile or other applications for download, you may download a single copy to your computer or mobile device solely for your own personal, non-commercial use.

The Company name, the term WELLWITHALL, the Company logo, and all related names, logos, product and service names, designs and slogans are trademarks of the Company or its affiliates or licensors. You must not use such marks without the prior written permission of the Company.

Prohibited Uses

User Contributions

The Website may contain message boards, chat rooms, personal web pages or profiles, forums, bulletin boards, and other interactive features (collectively, "Interactive Services") that allow users to post, submit, publish, display, or transmit to other users or other persons (hereinafter, "post") content or materials (collectively, "User Contributions") on or through the Website.

All User Contributions must comply with the Content Standards set out in these Terms of Use. Any User Contribution you post to the Website will be considered non-confidential and non-proprietary.

You represent and warrant that you own or control all rights in and to the User Contributions and have the right to grant the license granted above to Us and Our affiliates and service providers.

Content Standards

User Contributions must in their entirety comply with all applicable federal, state, local, and international laws and regulations. Without limiting the foregoing, User Contributions must not:

• Contain any material which is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable.

• Promote sexually explicit or pornographic material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.

• Infringe any patent, trademark, trade secret, copyright, or other intellectual property or other rights of any other person.

• Be likely to deceive any person, or promote any illegal activity.

• Impersonate any person or misrepresent your identity or affiliation with any person or organization.

Information About You and Your Visits to the Website

SMS Program Terms

NEW — Added July 2026

Program description. WellWithAll operates an SMS communications program that includes both transactional messages and marketing messages:

• Transactional messages are sent as necessary to fulfill your purchase or service your account, including order confirmations, shipping updates, refill reminders, and subscription management notifications. Transactional messages may be sent to customers who provide a mobile number at checkout as they are required to deliver your order.

• Marketing messages include promotional offers, wellness tips, product education, and brand communications, and are sent only to subscribers who have explicitly opted in.

Opt-In

Transactional messages may be sent as part of fulfilling your order and do not require separate marketing consent. Customers who provide a mobile number during checkout may receive transactional messages related to their order.

Marketing messages require explicit opt-in. You may opt into our SMS marketing program by submitting your mobile number via the sign-up form on our website, checking the opt-in box at Shopify checkout, or by texting WELLWITHALL to our SMS shortcode. All marketing opt-ins require double confirmation — you will receive a confirmation text and must reply YES before any marketing messages are sent. Subscribers who do not reply YES within 24 hours will not be added to the marketing program. Consent to receive marketing messages is never assumed.

Message Frequency

Message frequency varies based on your order activity, account status, and — for marketing subscribers — the program flows you are enrolled in. You will never receive more messages than you have consented to receive.

Costs

Message and data rates may apply depending on your mobile carrier and plan. WellWithAll is not responsible for any charges incurred through your mobile carrier.

Opt-Out

You may cancel your SMS marketing subscription at any time by replying STOP to any marketing message. You will receive a final confirmation of your unsubscribe request and will receive no further marketing messages unless you re-subscribe. To re-subscribe after opting out, reply START. Note that opting out of marketing messages will not affect transactional messages required to fulfill active orders.

Carrier Disclaimer

WellWithAll is not liable for delayed or undelivered messages. Delivery is subject to your mobile carrier's coverage and capabilities. Carrier support for short codes may vary.

No Purchase Required

Consent to receive SMS marketing messages is not a condition of purchase of any goods or services from WellWithAll.

Mobile Data

We do not sell or share your mobile phone number or SMS opt-in data with third parties for their own marketing or promotional purposes. Mobile data is shared only with our authorized SMS service providers as strictly necessary to operate the program, and only under binding confidentiality agreements. Disclaimer of Warranties

YOUR USE OF THE WEBSITE, ITS CONTENT AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE WEBSITE IS AT YOUR OWN RISK. Any legal suit, action or proceeding arising out of, or related to, these Terms of Use or the Website shall be instituted exclusively in the federal courts of the United States or the courts of the Commonwealth of Massachusetts.

Arbitration

At Company's sole discretion, it may require you to submit any disputes arising from the use of these Terms of Use or this Website, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying Massachusetts law.

Limitation on Time to File Claims

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR THE WEBSITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

Waiver and Severability

No waiver by the Company of any term or condition set forth in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.

Entire Agreement

The Terms of Use, our Privacy Policy, and our SMS Program Terms constitute the sole and entire agreement between you and ACL Nutrients Inc. (dba WellWithAll) with respect to the Website and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the Website.
